U.S. District Judge Sam Sparks Monday ruled in favor of Jester King Brewery, Authentic Beverage Co. and Zax Restaurant and Bar in a First Amendment claim against the Texas Alcoholic Beverage Commission.
The ruling now allows breweries to tell customers where they can purchase their product, since they can’t be legally sold at the brewery. Also, previously, beer that was above four percent alcohol by volume had to be labeled “malt liquor” or “ale,” and now it can be labeled “beer” or “ale” regardless of alcohol content.
I wish we were joking, but we’re not.
